Archer Faris, Inc. ("Archer Faris," "we," "our," or "us") values the trust you place in us when you share your personal information ("Personal Information"). This Privacy Policy ("Policy") explains how we collect, use, and share the information you provide when you access or use Archer Faris' services and websites including, without limitation, archerfaris.com, any Archer Faris mobile or desktop applications, and any software products we provide in connection with those services or websites (collectively, the "Services").

We reserve the right, without notice to you, to update this Policy periodically to reflect changes in our practices, technologies, or legal requirements. Each time you use the Services, please check the "Last Updated" date at the top of this Policy to review any changes. The Policy is effective as of the "Last Updated" date. By continuing to access or use the Services after an updated Policy is posted, you agree to the revised terms. Your use of the Services and submission of any information, including Personal Information, to us, constitutes acceptance and understanding of this Policy.

Types of Information We Collect

We may collect, store, and process, on your and/or your organization's behalf, certain information, including Personal Information, through our Services and through your use of our Services. "Personal Information" means information that identifies you or can reasonably be used to identify you.

  • Information You Give to Us: You may choose to provide Personal Information, limited to your name and corporate email address, by submitting forms on our Services (for example, to request a demo, join a waitlist, or ask for more information). You may also include additional details in a free-text message; in that case, we receive whatever data you submit. We do not request phone numbers, home addresses, Social Security numbers, payment card data, or other sensitive categories.
  • Information Collected Automatically (Limited): Like most websites, we may collect basic technical data when you visit our websites in connection with Services that are often not personally identifying (e.g., IP address, browser type, device/OS, etc.). We use this to operate the Services, understand traffic, and protect against fraud and abuse. We do not use cross-site tracking for targeted advertising.

How We Use Personal Information

We use Personal Information to:

  • Provide the Services.
  • To adjust offerings or services provided by us to you.
  • Respond to inquiries, demo requests, and waitlist sign-ups.
  • Operate, maintain, and improve the Services (including troubleshooting and security).
  • To provide you with information about our products and services that we believe you may find of interest.
  • Comply with applicable legal obligations and enforce our terms.
  • To better understand how users access and use the Services and offerings provided by us.

We do not sell Personal Information and do not use it for targeted advertising.

For clarity, we do not make any warranty, express, implied or otherwise, that we will be able to prevent loss, misuse, unauthorized access to, or alteration of personally identifiable information you provide to us. You make any disclosure of Personal Information to us at your own risk.

How We Share Personal Information

We may share Personal Information with third parties for the following purposes:

  • To Service Providers performing functions on our behalf (e.g., to support our websites and communications, hosting). These providers act on our instructions and are bound by confidentiality and data protection obligations.
  • For legal purposes (e.g., to comply with all applicable law, or to respond to lawful requests, subpoenas, or other legal processes by a governmental entity or third party).
  • For security purposes (e.g., to protect rights, safety and security.)
  • To third parties in aggregated, or non-personally identifying, forms of information about our Services users for marketing, advertising, research or other reasonable business purposes.
  • To protect or enforce our rights including with respect to our assets.
  • In the event of the sale or dissolution (bankruptcy) of assets, in whole or in part, of our business or any of its affiliates.
  • To provide products or services requested, and to provide you with information relating to products or services that we believe you may find of interest.

We do not sell or "share" Personal Information for targeted advertising under applicable U.S. state laws.

Cookies and Similar Technologies

Our Services may use technology, or those of third-party service providers, such as essential cookies, web beacons (clear GIFs, web bugs) and basic first-party analytics technologies to understand site usage, track user activity, collect website data, and improve performance. We may combine this data with the Personal Information we have collected from you. You can control cookies through your browser settings. We do not use cookies for cross-context behavioral advertising.

Third Party Links

The Services contain links to other, third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead, is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

Email Communications

If you provide your email address to us, we may use it to (i) notify you about changes to this Privacy Policy, (ii) send service- or request-related notices, and (iii) share information about product updates, events, or related educational content. You can opt out of non-essential emails at any time via the unsubscribe link in those messages. Please note that it may take a few business days for us to process opt-out requests. If you opt-out of receiving emails, essential service communications may still be sent in accordance with this Policy.

Data Location & International Transfers

We operate in the United States only. Personal Information is processed and stored in the United States, specifically in Amazon Web Services (AWS) U.S. regions. We do not knowingly transfer Personal Information outside the U.S. If that changes, we will update this Policy and implement appropriate safeguards.

Data Retention

We retain Personal Information as long as needed for the purposes described in this Policy, to comply with applicable legal obligations, resolve disputes, and enforce agreements. When we no longer have a legitimate business need or legal obligation to retain it, we will delete or de-identify the information.

Security

We implement reasonable technical and organizational measures designed to protect Personal Information. We host data in AWS and use protections such as encryption in transit and at rest where appropriate. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your U.S. Privacy Rights

Depending on your state of residence (e.g., California, Colorado, Connecticut, Utah, Virginia), you may have rights such as access, correction, deletion, portability, or the right to limit certain uses of Personal Information.

California (CCPA): If you are a resident of California and interact with us as a consumer, you have certain rights under the California Consumer Privacy Act or "CCPA" (Cal. Civ. Code § 1798.100 et seq.), including to request access to or deletion of your Personal Information (as defined in the CCPA). You may exercise these rights by contacting us at privacy@archerfaris.com. We do not sell or share Personal Information for cross-context behavioral advertising.

Appeals: If we deny a request, you may appeal by emailing privacy@archerfaris.com with the subject line "Privacy Request Appeal."

We will verify your identity before processing a rights request and will respond within the time required by applicable law.

Children's Privacy

Our Services are directed to business users and are not intended for children. We do not knowingly collect Personal Information from anyone under 16. If you believe a child has provided Personal Information in violation of this Policy, contact us at privacy@archerfaris.com and we will take appropriate steps to delete it.

Changes to This Privacy Policy

We may modify this Policy from time to time. Material changes will be noted by updating the Last Updated date at the top of this page. Your continued use of the Services after changes take effect constitutes acceptance of the revised Policy.
